Pericles commercial brand warranty

Important information about your statutory rights

This commercial brand warranty is provided by La Carrosserie Enfantine NV/SA, owner and importer of the Pericles brand, with registered office at Stapsteenweg 7, 9070 Destelbergen, Belgium, and registered under enterprise number BE 0405.871.457, hereinafter referred to as the ‘warrantor’. This voluntary warranty is additional to the statutory warranty and does not limit any statutory consumer right. Statutory warranty claims must be made to the professional seller from whom the product was purchased. Where the warrantor sold the product directly to the consumer, it also acts as the seller.


1. Scope and duration

This commercial warranty applies to all new Pericles products, including pushchairs, carrycots, baby and children’s furniture, textile products, bags, parts and accessories, purchased from the warrantor or one of its authorised professional retailers in Belgium, the Netherlands, France or Luxembourg.

The warranty applies for two (2) years from the date on which the product was delivered to the first purchaser.

It covers manufacturing, material and assembly defects that existed on delivery or become apparent during the warranty period under normal use. It may also apply where it cannot be shown that the defect existed on delivery, provided the warrantor can reasonably regard it as a manufacturing, material or assembly defect.

The product must have been used and maintained in accordance with the user manual and its safety and maintenance instructions.

The warranty attaches to the product and remains valid during the original period if ownership is transferred. The new owner must provide sufficient evidence of the original purchase and delivery date.

Repair or replacement does not start a new commercial warranty period unless these terms or mandatory law provide otherwise. The running period is suspended for the time reasonably required for repair or replacement.

2. Inspection on receipt

The purchaser is requested to check the product for completeness and visible damage after purchase or receipt. Visible transport damage or missing parts should preferably be reported to the seller promptly.

Failure to inspect or report immediately does not automatically result in loss of this commercial warranty or statutory consumer rights.

3. Making a warranty claim

A statutory warranty claim must be addressed to the professional seller. A claim under this additional commercial warranty may be made through the original seller, a designated service point or directly to the warrantor.

If a defect or possible safety risk is identified, use must stop immediately where continued use could worsen the damage or endanger the child, user or any third party.

The claimant must provide, insofar as reasonably possible:

·   evidence of purchase and the delivery date;

·   a clear description of the defect;

·   clear photographs or other relevant information; and

·   the type, item and/or serial number, where applicable.

A dated invoice, receipt, order confirmation, delivery note or other reliable evidence may be used. The original is not required where a legible copy or other sufficient evidence is provided.

The product must be reasonably clean insofar as needed for safe assessment or repair. Original packaging is not required. Only parts needed to assess the defect must be supplied, unless otherwise requested.

The consumer must not send the product directly to the factory. The factory is not a party to this warranty and does not handle consumer claims. Shipment is permitted only after instructions from the seller or warrantor.

4. Assessment and remedy

The seller or warrantor may inspect the product to determine the nature, extent and cause of the defect. The assessment may consider the product’s condition and age, use and maintenance circumstances, the manual and, where necessary, a technical examination.

Where the claim is covered, the warrantor will reasonably choose to repair or replace the defective part or the entire product free of charge. A replacement may be technically and functionally equivalent. A different colour or finish may be supplied if the original is unavailable.

The remedy will be provided within a reasonable time and without significant inconvenience. For an accepted claim, necessary examination, parts, labour and agreed transport costs are borne by the warrantor.

If the problem is not covered, the claimant will be informed. Uncovered work is charged only after clear prior information and express consent. This does not affect free remedies or other rights under the statutory warranty.

5. Exclusions

This commercial warranty does not cover damage or defects caused wholly or partly by:

·   incorrect, improper or negligent use, or use contrary to the operating, assembly, maintenance or safety instructions;

·   incorrect or incomplete assembly, disassembly, installation or securing, except where performed by or under the responsibility of the seller or caused by incorrect or unclear supplied instructions;

·   assembly on an unsuitable, insufficiently load-bearing or uneven surface;

·   failure to use a prescribed wall fixing or anti-tip device where required;

·   use for an unintended purpose;

·   exceeding the permitted weight, maximum load or another stated use limit;

·   insufficient, incorrect or overdue maintenance;

·   incorrect washing, cleaning, drying, ironing or treatment, or use of unsuitable or aggressive cleaning products;

·   normal wear and tear or ordinary signs of use;

·   an accident, fall, impact, scratch, dent, tear, cut or other external event;

·   airline, courier, removal or other transport after delivery;

·   incorrect storage or prolonged storage in unsuitable conditions;

·   fire, liquids, leakage, mould, prolonged moisture exposure, corrosion or extreme temperatures;

·   discolouration or material changes caused by sunlight, perspiration, saliva, food, cleaning agents or normal ageing;

·   normal characteristics and behaviour of natural materials, such as minor differences in colour, texture or grain and minor deformation or dimensional change caused by temperature or humidity;

·   damage to floors, walls or other property due to incorrect placement, assembly, movement or use;

·   modifications, repairs or maintenance not performed in accordance with Pericles instructions;

·   unsuitable or incompatible parts, mattresses or accessories;

·   continued use after a defect, instability or safety risk was identified; or

·   any cause not attributable to a manufacturing, material or assembly defect.

Parts and materials subject to normal wear, such as tyres, wheels, bearings, brake parts, handles, fabrics, upholstery, linings, fillings, seams, zips, hook-and-loop fasteners, elastics, press studs, prints, coatings, lacquer layers, hinges, drawer runners, closures and moving joints, are not covered solely because of that wear. Abnormal or premature wear caused by a covered defect may be covered.

An exclusion applies only where there is a reasonable connection with the reported defect. An unrelated modification, sign of use, repair or non-original accessory does not automatically result in refusal of the entire claim.

6. Territorial scope

The warranty is valid in Belgium, the Netherlands, France and Luxembourg. A product bought in one of these countries from the warrantor or an authorised retailer may be presented under the applicable procedure.

The warrantor may direct the consumer to the original seller or an authorised service point. If the original seller no longer exists or cannot reasonably be reached, the consumer may contact the warrantor directly.

Moving or transferring the product to another listed country does not automatically end the warranty. These arrangements do not limit statutory rights relating to domestic or cross-border purchases.

7. Liability and statutory rights

The warrantor’s performance under this commercial warranty principally consists of repair or replacement. To the extent permitted by law, it does not cover indirect or consequential loss that does not result directly from the covered defect.

Nothing excludes liability where mandatory law prohibits exclusion. In particular, this warranty does not limit the statutory warranty, any right to a price reduction or termination, product liability, rights in the event of death or personal injury, or any other mandatory claim.

8. Governing law and language

This commercial warranty is governed by Belgian law. This choice does not deprive the consumer of mandatory protection applicable in the country of their habitual residence.

The warranty may be supplied in several languages. A discrepancy may not be interpreted so as to limit mandatory consumer rights. For consumers in France, the official French statutory notice in the French version also applies.
